The 5% of users that are the reason for implementing STM (throttling)
Are they "cloned modems" or are they customers?

Be interestin if they are the result of cloned modems, as payin
customers are subsidising their use on the network.

I would have thought by now that you and many others would have come
to the conclusion has I have that it just isn't any use arguing with
VM they will have their way and they are just not bothered about
loosing a few thousand customers in so doing .
Given a choice after two previous excursions into the world of BT and
ADSL I know where I would sooner be no matter what VM think of doing
next, the most many people can get from ADSL is 8 Mb and some are
getting a hell of a sight less I will stick with my 20 from VM for
the same money with no phone line to pay for on top .

Ditto after 2 excursions into Virgin's (and previously NTL's) cable offering.

I'm payin £18 for an up to 24MB connection, and in reality it runs at a
constant 14Mb/sec no matter what time of day.

Mind you, this is on ADSL and not Cable )
