They wont cancel his account. He tried that but has to write to the Customer
Services manager and wait to see what she says... Could be up to 6 weeks for
a reply he was told

I'm not sure they can legally do this. Tell him to go to his
local Citizens Advice Bureau, explain the situation to them, and
they'll probs manage to get them to cancel the account and freeze
the debt etc. They're really good with credit card companies
(getting them to freeze the interest etc) so shouldn't have any
major probs with a company like Tiscali!

1) If a service was provided and used during this period Tiscali are
entitled to payment in full. I don't know the Tiscali terms and conditions
but I suspect they merely reserve the right to cancel an account once it has
become 30 days in arrears. They have chosen not to exercise that right but
to continue to supply the service.

2) If you or your friend were using Tiscali's service one of you should have
been aware that you were not paying during this period for something that
you knew you ought to have been paying. Tiscali entered into a contract
with you or your friend to supply a service which you or your friend agreed
to pay for. That places some obligation on you or your friend to see that
the service has been paid for. The mistake seems to be at Tiscali's end but
they will claim that you should have been aware that they appeared not to be
collecting the money and should have brought this to their attention. Write
to them to see if you can agree a schedule for repayment. They'll probably
agree to this but be polite about it; they have a right to immediate
payment in full and most magistrates court would uphold that right.

3) There is only one way it could be argued that the bill should not be paid
and that is if the service wasn't being used at all during this period. If
you or your friend can say that you were aware that you were not paying for
the service but that you believed Tiscali had withdrawn the service and so
made no attempt to use it then you have a chance. But don't say that if its
not true. Tiscali's records will demonstrate if the line / account was
used.

4) Your biggest concern ought not to be the bill; that's going to be paid,
one way or another. No, your real concern should be the ADSL line. That's
why I suggest that you are conciliatory, rather than antagonistic, in your
dealings with their Customer Relations people.
