On an ADSL line can using or not using the phone affect the
downloading?

My daughter has just had 256/128 installed from pipex and she has had
two occasions when downloading was not appearing to work and on
picking up the phone, hey presto, it worked.

Has she checked that all the phones, dial-up modems and fax machines on the
line have been fitted with microfilters? If one phone etc is missed,
broadband performance can be severely affected: the more usual symptoms that
I've experienced are a complete lack of ADSL carrier detected by the modem
or router, so detection of carrier but with reduced performace is a bonus!

Check also for dodgy extension wiring leading off from the BT master socket.
If all the phones have microfilters, simplify the wiring to just BT socket
with ADSL modem plugged into it via microfilter (if the arrangement of the
computer will allow this) and then gradually add in extension wiring and
phones bit by bit to identify the culprit.

Right, I haven't looked in to this as I am with Pipex and two of my
phones run without a filter and with no noticable background noise and
the adsl appears to work ok

yes, it can take it out of sync if the phone is unfiltered or dodgy.
Equally in some fault situations it can make it start to work.

need to look at the modem sync light as "downloading" can stop for 50
reasons

you are lucky then, if you want to be certain of avoiding problems you
should filter them.
