My rights? Faulty product, what should I do?

I need to know my rights on this situation I have here. I want a full
refund.

I was all hoping to get setup with broad band, wirelessly.

Unfortunately, this failed, because of a faulty product. I bought an
"eTec Wireless ADSL router". I can't find any product number! Perhaps
this is their first product then? That figures. It's just an "eTec" as
far as the box says. The manual was nearly useless (flimsy few pages
of technical nonsense that didn't address my problems).

Anyhow, the wireless part never worked. I thought, perhaps it was a
problem with the firmware image, so I pressed the "Update code
firmware" button on the modem's setup page (accessed via
http://10.0.0.2)

Since then, the modem has never worked. Even pressing the reset button
doesn't do anything!

Before it only half worked, now it works not at all!

What are my rights? I want a full refund. The company says I need to
send the modem back, then they'll send it back to the manufacturers,
who will look into it. They said then the manufacturers may either
give us a refund or fix it and return it.

That's just not acceptable. I'll be left in the meantime, with no
broadband access! I may have to wait weeks (who knows what country the
original manufacturers were in, and delivery of such large products
may take a few days anyhow inside the country)

The product never worked 100% anyhow, and I just don't want to put up
with the bad quality product they've given to me. I want broad band, I
want it now, and I want it without having other people keep my money
that they have not earned! (making faulty products is not earning, but
cheating)

Can I force them to give me a refund? If so, how? What are my rights?

Please reply by email, if you don't mind? If you do mind, just reply
here.

Thanks a lot!

Sounds like a Hong Kong or Taiwan box. You don't have much leverage. If the
store publishes a return policy (sometimes included with the receipt) it
spells out exactly what your options are. And those options are probably
what they offered you - return the box, get a refund or a replacement if
they can't fix it.

If I were you I'd ask for a loaner at least, and I'd make the request in
person to the highest level of management I could find. I would threaten to
go to the better business bureau and possibly spread bad word about them on
the internet (I probably wouldn't actually do that). In theory you could
sue - anyone can sue over anything at any time - but it's simply not worth
it for item that cheap, and your chances of winning are proably nil.

You could threaten to take them to small claims court, and they might decide
to give you a replacement to make the annoyance go away. But if you have to
take them to court, you will still be out the court costs and your time,
whatever the result.

Always check the return policy in detail before buying anywhere - and that's
especially important for e-purchases.

From what I understand anything purcased, if it is faulty as a consumer you
have the right for a replacement, or a refund.

This link maybe of some help to you if you are a UK resident:

You do have a right, but the right is enforced ultimately through the
courts. I don't know about the U.K., but in the U.S. that can be expensive
and time-consuming, with no guarantee of success.

Do you went out and bought the CHEAPEST device you could find, couldn't get
the wireless feature to work, so you guessed that replacing the operating
system of the device might fix it. You then proceded to do a firmware
upgrade without having the slightest idea what you were doing, and broke
your new magic wirless boxen. And you have the gall to complain about it?

Sounds to me like the manufacturer and reseller are doing exactly as
they should: offering you repair or replacement (their option) of an
apparently defective unit. This is usually spelled out pretty clearly
in the warranty. You don't have recourse unless they default on the
buyer/seller contract. They've offered to do what they said they'd
do. You can either let them try to make it right, or chalk it up to
experience and purchase something else. Also, you may want to
re-think your expectations on the performance of no-name products.
Just a suggestion.
