If someone uses my router

If someone uses My wirless router without me knowing , like a neighbor, and
he does something illegal can it be traced back to him or will I be in crap?
I have it password protected now, because my roomate was out with his
laptop and was picking up someone elses connection and surfing the net.

it is traced back to your cable modem / dsl / router ....
