Domain Name Problem

I have had registered a name for several years - and my registar had
changed. I went to renew and did so over the phone - made my payment
online- received a receipt. However, the receipt said respond to email
with the confirmation number. Well, I was on the phone with the manager
when I did this - and he took the confirmation number and said it was
renewed. I had done this with several other names with the same company
and there were no problems.

Last week I checked and discovered the domain name was now registered
with someone else - and of course the manager of this company is no
longer there--- they are telling me there is nothing that can be done
even if I had a receipt.

They are willing to try to compensate me with some free webhosting and
a free domain registration. The name was short and .com -- and I feel
had some value and was in my overall scheme of developing websites over
the next couple of years.

Does anyone have a suggestion as to what I can do?

I appreciate any input.

Was your credit card debited? That will help your case.

If you've had the name previously, then that will also add weight to your
case.

Is the domain now with a different registrar? That will make it more
difficult because it will no longer be under the control of your registrar.

Sounds like your registrar screwed up, but I doubt you'll get anywhere
unless you're willing to push it and are prepared to take legal action.

Thank you Dan -- It was via a debit card. I am sure it is a different
registar. The company that I used said there is absolutely nothing I
can do except refund my registration fee-- however, as I mentioned they
have offered to register several names and provide a hosting package.
However, I had registered the name for the last three to four years. Is
there no governing board that can state - the name was paid for and a
mistake was made and reassign the name to me?

You might be able to take it up with ICAAN (www.icann.org) as they are the
governing body, but I really don't know. I'm not a legal expert, but I
would think that you would have a legal claim to the name seeing that
you've had it and that you tried to renew it in good faith. It's not your
fault that the registrar screwed up.

Take this advice with a grain of salt, because, as I said, I'm not a legal
expert of any kind. But if it were me, I wouldn't accept a refund or any
other offer of recompense unless you're willing to give up your claim to
the domain. Accepting recompense, in my opinion, would imply that
you've given up the claim.

Madonna made a claim against a porn web site that was using her name. I
believe that it was ICAAN that took it away from them.

And what of the new owner who bought the name in good faith?
They're the one you need deal with now, and unless you can
prove some significant commercial attachment to the name you
got buckleys. On the other hand, if the current owner is an
obvious namesquatter you can go them for that, providing you
can convince the judge

lol, i felt stupid for actually trying this but wow.. actually works..
also i guess, this is how to change the "Standby" button into a
"Hibernate" button..
