Am i breaking the law????

hello everyone,
i recently purchased a wifi pcmcia card for my laptop and quickly discovered
a hot spot close to where i live. i managed to connect to this network
straight away and was surfing the net in no time, all this seems like great
fun but does anyone know if i can get bollocked for this or what?

yes, without permission. Or, it could be a free "hotspot", ask the owner of
the network if it is.

no its definetly no free hot spot its by the side of someones house. me and
a pal are sittin up there now using someone elses connection. can they tell?
and what would be likely to happen if they found out?

Ray, you (or at least your email address) appear to be in the USA,
whereas the original poster appeared to be in the UK. Could you
clarify whether your response was based upon US law or UK law?

Walter,

It was based on neither. With all respect, he will not go to jail in the
US for hitchhiking on a private residential WiFi signal. Obviously, I can't
speak for how laws are interpreted or enforced in the UK.

On the other hand, if he was thought to be maliciously tapping a network
wireless signal from a government source in the US, he could very well be
charged with some violation, depending on the area and jurisdiction.

yes they can tell if they have the right software.
They can only see where you are connected to and your IP address.

If the person whos network you are using does not intend to make it freely
accessible, you are certainly committing an offence under the Computer
Misuse Act.
(in the UK).
IIRC, the maximum penalty is a few months to a few years jailtime.
However, if it would actually be prosecuted is another question.

That would depend on the owner. If they made it publicly available, no
problem. If they didn't, it's theft of service. However, they should have
at least used WEP, if they didn't want to share.
